Circular Of Beijing Municipal People's Government On Printing And Issuing Provisions Concerning Encouragement Of Returned Students To Come to Beijing for Pioneering New Undertakings Or For Work Political Document No. 19 issued by Beijing Municipal People's Government in 2000

 

 

 

 

People's Governments of Various Districts and Counties, Various Commissions, Offices and Bureaus of the Beijing Municipal People's Government, and Various Institutions Attached to the Beijing Municipal People's Government:

 

To encourage returned students to partake in the modernization drive in China's capital, increase the intensity of Beijing's introduction of high-tech professionals and create a good work and living environment for returned students, the 72nd meeting of the mayor's office adopted theProvisions of Beijing Municipality Concerning Encouragement of Returned Students to Come to Beijing for Pioneering New Undertakings or for work,which are now printed and issued to you. Please earnestly implement the provisions.

Provisions of Beijing Municipality Concerning Encouragement Of Returned Students To Come to Beijing for Pioneering New Undertakings or for work

 

Article 1 These Provisions have been formulated with a view to encouraging returned students to come to Beijing to pioneer new undertakings or for work, accelerating the development of the Zhongguancun Science Park, and advancing the development of high-tech industries and the introduction of an innovative system.

 

Article 2 Returned students referred to by these Provisions mean among government-sent students or self-funded students who go abroad for advanced study, professional technicians and managers with the master degree or higher (including the master degree) or with senior professional tiles.

 

Article 3 Major forms for returned students to come to Beijing to pioneer new undertakings or for work are as follows:

 

(One) Wholly-owned or joint venture high-tech enterprises with stocks contributed with technology or founded in the form of investment;

 

(Two) Founding or leasing various types of economic entities and research and development institutes;

 

(Three) Carrying out academic exchanges and research cooperation or undertaking research projects;

 

(Four) Going to institutions, large and medium-sized state-owned enterprises and other economic organizations to take up posts or hold concurrent jobs;

 

(Five) Going to the post-Ph.d. station to engage in post-Ph.d. research;

 

(Six) Working with Beijing's enterprises or institutions overseas; and

 

(Seven) Other forms.

 

Article 4 When coming to Beijing to pioneering new undertakings or for work, returned students shall not be restricted by the place of their permanent residential registration before going abroad. On the strength of the certificates of their work units or their licenses for industrial and commercial operations, they may apply to the Beijing Municipal Bureau of Personnel for receiving theWork and Accommodation Certificate of Beijing Municipality for (Returned Students).Returned students may reside in Beijing either for a long time or for a short time, and are free to enter or leave Beijing.

 

Article 5 Should returned students (including their spouses and children) have obtained a foreign citizenship, they may, on the strength of theWork and Accommodation Certificate of Beijing Municipality for (Returned Students),apply to the public security department for receiving theResidential Certificate for Foreignersthat shall be valid for two years and the annual multi-entry visa. In case they come to Beijing to stay for such a short time as to be unable to leave China on schedule, they may apply to extend their visas. In case they fail to obtain the entry visas abroad because of the urgency of the time or for other reasons, they may apply for the port of entry visas according to relevant provisions.

 

With respect to returned students coming to Beijing to pioneer new undertakings or for work, when they go abroad again for work, study or investigations or to take part in relevant academic activities, relevant departments shall simplify the handling of relevant procedures.

 

Article 6 Should the returned students with Chinese passports coming to Beijing to pioneer new undertakings or for work want to obtain Beijing's permanent residential registrations, they may, on the strength of

 

theWork and Accommodation Certificate of Beijing Municipality for (Returned Students),handle according to relevant provisions with the public security department the procedures on obtaining such registrations.

 

For returned students who have obtained Beijing's permanent residential registrations, their spouses and children under the age of 18 may have such registrations simultaneously and are exempt from paying the fees for the birth of children in excess of the government-set quota. Should they have no children with them, one child of theirs already working may have such a registration simultaneously with their parents.

 

Article 7 For returned students returning to China to stay for a short time and coming to Beijing to pioneer new undertakings or for work, their work units may provide, in the form of contract, housing for them. For the returned students with Chinese passports, they may, on the strength of theWork and Accommodation Certificate of Beijing Municipality for (Returned Students),purchase within districts under the jurisdiction of Beijing apartments for sale, affordable apartments and the purchased government-owned apartments that have been put on the market with approval.

 

Article 8 When the children of returned students coming to Beijing to pioneer new undertakings or for work need to go to kindergarten or go to school in the compulsory educational phase, the educational administrative department of the district or county where they reside shall make arrangements and handle for them the procedures concerning school entry and school transfer, without collecting any fees other than specified by the government. The children who have already studied in a foreign university or college may apply to be placed in an appropriate class in a university or college in the Beijing area. For those sitting in the national unified examinations for post-graduates, universities or colleges in Beijing shall, under the same conditions, give them priority in enrolment.

 

Article 9 Returned students coming to Beijing to pioneer new undertakings may, on the strength of their Chinese passports, register directly, with their registered capital subject to the relevant minimum standards.

 

Article 10 The incomes of returned students coming to Beijing to pioneer new undertakings or for work from technology transfers and technological development business and associated technical consulting and technical service are exempt from the business tax with the certification by relevant departments. Returned students founding high-tech enterprises in the Zhongguancun Science Park may enjoy various preferential policies available to high-tech enterprises in Beijing.

 

Article 11 Returned students shall pay, according to law, taxes on the legal incomes they earn from pioneering new undertakings or from work in the Zhongguancun Science Park. After the taxation department examines and verifies their tax payments and produces special receipts, they may use all their after-tax incomes to buy foreign exchanges and carry and remit such exchanges out of China.

 

Article 12 Returned students may apply for the science and technology industrial funds of the Beijing Municipal Commission of Science and Technology on the high-tech items and products they develop and produce. A certain ratio of Beijing's expenditures for science and technology shall be arranged annually specially for financing returned students in engaging in scientific research. Loans with discount interest rates shall be extended to high-tech enterprises founded by returned students.

 

Article 13 For returned students coming to Beijing to conduct scientific research or engage in technological upgrading projects, or those having research projects with patents or inventions and having new products and technology to develop, their work units shall offer them experimental sites, equipment and other necessary conditions, may provide necessary expense financing and shall permit them to hire via selection assistants at home and abroad.

 

Article 14 Should returned students coming to Beijing to pioneer new undertakings or for work need to import a small amount of agents, raw materials or accessories because of their scientific research, their work units shall file an application to the custom office. Upon approval, the above items may enter China duty-free. The foreign currency required for the purpose shall, on the strength of valid certificates and commercial bills, be reported to the foreign exchange administrative department for approval and purchased from a designated bank.

 

Article 15 Should returned a student come back to China for work within one year after graduation, he/she may purchase one domestically-built car duty free in accordance with the customs provision on the purchase of cars for personal use by the students studying abroad who return to China for service.

 

Should returned students have worked in Beijing for more than one year, have already obtained the permanent right of abode abroad or have obtained foreign citizenship, an reasonable amount of luggage, belongings and durable consumer goods they carry for their own use, as well as one car, shall be subject to the provisions on managing the entry and exit items carried by foreign experts coming to China for work.

 

Article 16 When an enterprise or an institution in Beijing employs returned students, their remuneration shall be subject to consultation between the work unit and returned students and be determined with priority given to the latter. When employing returned students, an enterprise may set wage standards on their own, depending on circumstances. When employing returned students, an institution may set salary standards with priority given, in reference to the same category of personnel within it. For those who have made outstanding contributions, special post allowances no higher than ten times of their salary may be offered.

 

Article 17 Returned students hired to take up specialized technical posts in research institutions, educational establishments, health institutes and other institutions or enterprises in Beijing shall not be restricted by the quota of professional titles for their work units. In case returned students did not obtain specialized professional titles abroad, the Beijing Municipal Bureau of Personnel shall directly define their professional titles according to their overseas experience and academic knowledge. Returned students who obtained abroad the practitioner qualification that is also acknowledged by China may go directly to relevant departments to handle relevant certificates on professional and technical practitioner qualification.

 

Article 18 The length of work of returned students before going abroad, during their stay abroad and after returning to China that may be calculated continuously according to relevant state provisions shall be calculated continuously. Returned students may join social security in line with Beijing's provisions.

 

Article 19 Research institutions, educational establishments, health institutes and other institutions are being encouraged to actively to attract returned students to come to Beijing for work. Returned students shall not be restricted by the size of work units, the quotas for employing more workers, wage funds or the total wage amount.

 

Article 20 For the purpose of encouraging returned students who have made outstanding contributions, the Beijing Municipal People's Government has established the Beijing Municipal Pioneering Prize for Returned Students. The winner of the prize may, according to relevant provisions, apply for the reward for scientific and technological progress and other prize items.

 

Article 21 With a view to attracting returned students to come to Beijing to pioneer new undertakings or for work, great efforts shall be made to speed up construction of the pioneering park for returned students; the information bank regarding returned student professionals shall be established, and a network window in Beijing shall be opened to attract the students returning from overseas, with the introduction focusing on information related to the development of science and technology in Beijing and information pertaining to key industries. Related consulting service on policy shall also be provided for returned students.

 

Article 22 The legitimate rights and interests of returned students shall be protected according to law. The intellectual results from pioneering new undertakings or work by returned students in Beijing, and the legal incomes and other rights and interests of such students shall be protected in accordance with the provisions of relevant laws, decrees and regulations.

 

Article 23 The Beijing Municipal Bureau of Personnel shall be in charge of certifying the qualification of returned students, and shall undertake to coordinate various related departments to provide high-quality, highly efficient and convenient "one-station office" service for returned students, and try to create a good environment for returned students coming to Beijing to pioneer new undertakings or for work.

 

Article 24 The Beijing Municipal Bureau of Personnel shall be responsible for interpreting the specific questions arising in the course of implementing these Provisions.

 

Article 25 These Provisions shall take effect as of May 1, 2000. In case the relevant provisions concerning returned students coming to Beijing to pioneer new undertakings or for work that had been released previously contradict these Provisions, these Provisions shall be prevailing.
